Waiver, Release of Liability, and Service Agreement

412 DYNO SHOP WAIVER, RELEASE OF LIABILITY, AND SERVICE AGREEMENT

1. Assumption of Risk
I understand that dynamometer testing, diagnostic procedures, and vehicle tuning involve inherent risks, including but not limited to mechanical failure, engine damage, or other damage to my vehicle. I voluntarily assume all risks associated with these services.
2. Release of Liability
To the fullest extent permitted by law, I agree to release, indemnify, and hold harmless 412 Dyno Shop, LLC, its owners, employees, and agents from any and all claims, damages, or liability arising out of or related to the testing, tuning, or operation of my vehicle, including but not limited to claims arising from the negligence of 412 Dyno Shop.
3. Limitation of Liability
To the extent permitted by law, the total liability of 412 Dyno Shop, LLC for any claim arising out of services performed shall be limited to the total amount I paid for those services. Under no circumstances shall 412 Dyno Shop, LLC be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of revenue, loss of profits, or damage to other property.
4. No Warranty
412 Dyno Shop, LLC makes no warranties, express or implied, regarding the services or equipment used, except as expressly stated in this agreement.
5. Limited Adjustment Policy
I understand that 412 Dyno Shop offers a 30-day adjustment period for calibration-related issues. After 30 days, I am responsible for any additional costs related to recalibration or tuning. Any modifications or changes made to the vehicle after delivery void this adjustment policy.
6. Authorization for Diagnostics and Minor Repairs
By signing this agreement, I authorize 412 Dyno Shop to perform up to one (1) hour of diagnostic work and minor repairs at a rate of $125 per hour if necessary to proceed with tuning or testing.
7. Mechanical Condition and Delays
I understand that underlying mechanical issues, incompatible parts, or improper installation may delay or prevent completion of tuning services. In such cases, additional repairs may be required and scheduled separately. No guarantees are made regarding completion timelines when mechanical issues are present.
8. Fuel Requirements
I understand that proper fuel type and quantity are required for testing and tuning:

• If my vehicle has less than one-half (1/2) tank of fuel, I authorize 412 Dyno Shop to add fuel at my expense, plus a $125 labor charge.
• If my vehicle contains the incorrect type of fuel, I authorize 412 Dyno Shop to drain and replace the fuel at a rate of $125 per hour, plus fuel cost.

9. Authorization to Operate Vehicle
I authorize 412 Dyno Shop, LLC, its employees, and agents to operate my vehicle on streets, highways, or other areas as necessary for testing, inspection, and service.
10. Additional Labor Charges
I understand that additional labor charges may apply if tuning is delayed or complicated due to faulty, incompatible, or low-quality components (including but not limited to throttle bodies or fuel injectors). Such labor will be billed at $125 per hour.
11. Billing and Storage Policy
I agree that:

• My invoice may be updated and billed every second Friday while my vehicle remains at the shop.
• I may be required to pay for parts in advance for mechanical work or modifications.
• If my vehicle is not picked up within seven (7) days of completion or notification, I will be charged storage fees of $35 per day for outside storage or $65 per day for inside storage, unless prior arrangements are made.

12. Taxes
I agree to pay any applicable sales or use taxes related to the services performed.
13. Mechanic’s Lien
I acknowledge and agree that 412 Dyno Shop, LLC has a mechanic’s lien on my vehicle for all unpaid services, repairs, parts, and related charges, as permitted by applicable law.
14. Acknowledgment
I acknowledge that I have read and understand this agreement in its entirety and voluntarily agree to its terms.
